PLEASE READ THESE TERMS OF SALE CAREFULLY BEFORE USING THIS SITE

This is a legal agreement between the person or organization (“Customer” or “you”) agreeing to these Terms of Service (“Terms”) and ServU Tech. When we refer to “ServU Tech,” “we,” “our,” or “us” in this policy, we are referring to ServU Tech, and all of its subsidiaries and affiliates, including ServU Files, ServU Mail and ServU Now. By accepting these Terms, signing an Order, or using the Services, you represent that you are of legal age and have the authority to bind the Customer to the Order, these Terms, and the applicable Service Descriptions (collectively the “Agreement”).

Listings on this website are not an offer to sell goods, rather, they are advertisements to receive offers. Any offer/order for more than 3 units per address, customer or company may be rejected, and all orders are subject to review and acceptance by ServU Tech. As all prices are subject to change, your order may not be accepted or we may have to communicate price changes or availability issues to you after you place your order.

Permission to use documents delivered from this World Wide Web site and/or server and related graphics is restricted. The name of ServU Tech or any of the above trademarks or logos may not be used in advertising or publicity pertaining to distribution of this information without specific, written prior permission. The information contained in this website is subject to change without notice. We are not responsible for typographical, technical, or descriptive errors of products herein.

Order Acceptance Policy
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. ServU Tech reserves the right at any time after receipt of your order to accept or decline your order for any reason. ServU Tech reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. All orders placed over $2,000.00 ( USD ) must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verifications or information before accepting any order. ServU Tech is a seller/reseller to end user customers and does not accept orders from computer dealers, exporters, wholesalers, or other customers who intend to resell the products offered by ServU Tech.

Typographical Errors
In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, ServU Tech shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. ServU Tech shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, ServU Tech shall immediately issue a credit to your credit card account in the amount of the charge.

Return Policy and 30 Day Limited Guarantee
Most products you buy from ServU Tech are backed first by the product manufacturer's or supplier's warranty, if there is one. Unless otherwise specified in the item listing on our website, on the receipt or packing slip, or in the following terms, ServU Tech may accept qualified and conforming products for exchange or refund within 30 days of the original purchase date. ServU Tech cannot process returns for products or services purchased from another source. Indirect orders of products or services must be returned to the source from which they were purchased and are subject to the return policies of that source. ServU Tech reserves, at its sole discretion, the right to refuse any refund or return request.

Electronically distributed (downloadable) products and services are generally non-refundable. Refunds may be issued if the purchased product cannot be installed or made to work as advertised. Refunds are provided only after a support team member has assisted with your installation or has verified the product was properly installed. This may or may not include logging into your site to check your settings and to make any necessary adjustments to our software configuration files. Refunds will not be issued if we do not receive your request for a refund within 30 days of the purchase date.

All returns require a return authorization number to be issued prior to being returned. Returned products must be in new condition, unopened, include original outer packaging and be received by us within 30 days of the purchase date. We reserve the right to refuse a return or charge a restocking fee for damaged, incomplete or otherwise non-conforming returns. Returns will not be accepted without a return authorization number issued by ServU Tech or when the product manufactures or distributors return policies supersede ours.

REGARDING BUNDLES
Bundled items are included while supplies last. Items of similar or greater value may be substituted.

REBATE COUPONS
Rebate coupon redemptions are limited to ONE PER ADDRESS only, unless otherwise noted.

WARRANTY LIMITATIONS
There are no other express warranties or conditions respecting the equipment. Implied warranties, if any, are limited to the duration of the express warranty provided herein. Some states do not allow limitations on how long an implied warranty lasts so that the foregoing limitation may not apply to you.


LIMITATION OF LIABILITY
In no event shall ServU Tech or any of its subsidiaries or affiliates be liable for any indirect, special, incidental or consequential damages including but not limited to loss of use, loss of data, loss of business or profits. Some localities do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

PROCESSING TIME
Physically shipped products:
Your order is reviewed by our Order Entry Department to ensure that the order is accurate, the payment method is valid, and you are authorized to use this payment method. Once your order has passed the review, in-stock item(s) are pulled and shipped within 24 business hours. If the item(s) on your order are out of stock, they will not be shipped until we have received and processed the backordered inventory.

Electronically distributed products:
Once you place your order, process the payment and we receive confirmation that the payment has cleared, you will be able to download the item(s) you've purchased. Payments typically clear within seconds of the completed payment process so download links are usually activated and available by the time our payment processor redirects you back to our site. eChecks take 3-5 business days to clear so your download link(s) will not be activated until then if you choose this form of payment.

USPS First Class Mail: 2-3 Business Days
USPS Priority mail: 2-3 Business Days
FedEx Ground: 1-7 Business Days, based on distance to the destination
FedEx Express Saver: 3 Business Days
FedEx 2Day: 2 Business Days
FedEx Standard Overnight: Next-business-day, afternoon

Note: Saturday & Sunday deliveries are not available.

TOTAL TIME FOR DELIVERY
Total time is based on the amount of time it takes to get payment authorization, order processing, and the transit time from the carrier. This can range from 24 hours to 10 days for in-stock items.

SHIPPING AND HANDLING RATES
Our customer-friendly shipping schedule is calculated on the ACTUAL WEIGHT or DIMENSIONAL WEIGHT of your shipment and the TYPE OF SHIPPING SERVICE that you specify (mail, ground, air). Shipping and handling charges will be applied to all orders placed with us. If your order must be shipped in multiple boxes, or in separate shipments in the event an item is not in stock and must ship at a later date, shipping and handling charges for the entire order will be assessed at the point when the first item is shipped. We charge only ONCE for shipping and handling, for the entire order. Should you have any questions or concerns regarding these charges, feel free to contact us.

Credit / Debit Card Authorizations
An authorization on a credit or debit card is a hold against your banks credit card spending limit. When the goods are shipped, a charge for the total amount of the order shipped will be sent to your credit card bank. Your bank should release the authorization when the charge is received. A charge is the only time a transfer of funds is completed; an authorization is not a transfer of funds.

GIFT CERTIFICATE TERMS
The ServU Tech Gift Certificate is redeemable for merchandise or services only. The Gift Certificate may not be redeemed for cash except where required by law. The value of the Gift Certificate will not be replaced if lost, stolen, destroyed or used without your permission. Your use of the ServU Tech Gift certificate constitutes acceptance of the terms and conditions herein.

Export Regulations
If this transaction involves an export under the U.S. export regulations, the commodities, technology and/or software sold or distributed under these terms and conditions of sale exported from the United States by ServU Tech were exported in accordance with such regulations. Diversion, use, export or re-export contrary to United States law is prohibited. The commodities, technology and/or software sold or distributed under these terms and conditions of sale may not be exported or re-exported to Cuba, Iran, Iraq, Libya, Sudan, North Korea or Syria or to entities and persons that are ineligible under United States law to receive United States commodities, technology and/or software. In addition, manufacturers' warranties for exported products may vary or may be null and void for products exported outside the United States.

Dispute Resolution
You agree that all matters relating to your access to or use of the Site, including all disputes, will be governed by the laws of the United States and by the laws of the State of Virginia without regard to its conflicts of laws provisions. You agree to the personal jurisdiction by and venue in the state and federal courts in Stafford County, Virginia, and waive any objection to such jurisdiction or venue. Any claim under these Terms of Use must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred. In the event of any controversy or dispute between ServU Tech and you arising out of or in connection with your use of the Site, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If we are unable to resolve any such dispute within a reasonable time (not to exceed thirty (30) days), then either party may submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law.

GOOGLE TRANSLATES

Terms of Use
The Google Translate service is a means by which translations of English content from our website are provided solely for the convenience of non-English speaking users of the website. The translated content is provided solely by Google and we do not have any input or control over the translated content. The English language version of the content, as provided by ServU Tech is the only definitive and binding version, and we are not bound by the non-English translations provided by Google Translate. The use of the Google Translate functionality and/or content is also subject to standard terms and conditions and the terms of use of our website. These standard terms and conditions and terms of use may be changed by us at any time without notice.

Use of Google Translate
The Google Translate service is free to ServU Tech users and is intended only as a tool to assist in the translation of our website content. Any other uses, including, without limitation, the incorporation of, advertising into, or the placement of advertising associated with, or targeted towards, the Google Translated content, are strictly prohibited. You must use the Google Translate content as provided and you may not edit or modify the text, technology, content or links supplied.

Right to Discontinue Service
ServU Tech reserves the right to cease providing Google Translate functionality and/or content at any time without notice. ServU Tech assumes no liability for, and expressly disclaims responsibility for, your use of the Google Translate functionality or content or for your reliance on the accuracy of its translations.
